Florida has introduced a major piece of legislation that could reshape how kratom is produced, sold, and consumed in the state. Senate Bill 1734 (2025), titled the Florida Kratom Consumer Protection Act, is currently moving through the legislative process — and it could bring the most comprehensive regulatory framework for kratom Florida has ever seen.
Here’s what you need to know.
What Is SB 1734?
Senate Bill 1734 is a proposal to regulate kratom as a consumable product — not ban it. The goal is to keep natural kratom legal while clamping down on adulterated, synthetic, or dangerously potent products that could put consumers at risk. It expands upon Florida’s 2023 Kratom Act by adding rigorous product testing, labeling, and registration requirements.
If passed, the bill would go into effect on July 1, 2025.
Who Does This Affect?
• Retailers (smoke shops, kava bars, convenience stores, online vendors)
• Manufacturers and distributors who process or package kratom
• Consumers who regularly use kratom or are concerned about purity and safety

How This Will Impact Our Competitors
For many kratom companies in Florida — especially unregulated online vendors, under-the-radar processors, or kava bars selling house blends — SB 1734 is going to change everything:
• Unlicensed or “cottage food” operations will be forced out. Anyone producing kratom without a food establishment permit will no longer be allowed to operate legally.
• Synthetic or enhanced kratom products will be banned. Brands that rely on lab-made alkaloid boosters or spike their products to increase perceived potency will be subject to felony charges.
• Many vendors won’t be able to afford compliance. Testing every batch, maintaining FDA registration, and reworking packaging/labeling could push small, unprepared players out of business.
• Shady marketing is over. Brands selling flavored kratom that mimics candy, energy drinks, or that use cartoon-style packaging will be pulled from shelves.
In short, low-quality brands, backroom processors, and sketchy white-labelers are going to get wiped out — either by legal enforcement or by the cost of doing business the right way.
Why This Won’t Affect Us
We’ve been preparing for this — and operating above these standards from the start.
• All of our kratom products are already third-party lab tested for alkaloids, heavy metals, solvents, and microbial safety.
• We use FDA-compliant, food-grade packaging and clear, accurate labeling that exceeds what SB 1734 requires.
• We only source naturally grown kratom with no synthetic alkaloids or concentrates.
• We’re already registered with FDACS and maintain all necessary business licenses and food safety documentation.
• We sell to adults 21+ only, and we’ve never marketed kratom in child-attractive formats.
In fact, we welcome this legislation — because it forces everyone else to play by the rules we already follow. We’ve invested in doing things the right way, and now that effort will shine through even more.
When SB 1734 passes, we won’t have to scramble. We’ll already be ahead of the curve — and our customers will continue to get the same safe, reliable, high-quality kratom they always have.
Bottom Line
SB 1734 isn’t a kratom ban — but it’s a major shakeup. It’s going to raise the bar, eliminate shady vendors, and make the Florida kratom industry cleaner, safer, and more trustworthy.
We’re ready for it.
